Favorable Order for Protection in Minnesota Court of Appeals by JMSK Attorney David Moody

David Moody was co-counsel on a successful defense of an appeal after he received a favorable Order for Protection ruling following a District Court trial. The trial court granted the OFP on behalf of Mr. Moody’s client and against the abuser. On appeal, after briefing and oral argument, the Minnesota Court of Appeals dismissed the challenge to the constitutionality of a provision of the Minnesota Domestic Abuse law, Minn. State §518B.01, deciding that the appellate failed to properly notify the Minnesota Attorney General. Both David Moody and Brandon Zumwalt handle family law cases, domestic abuse cases, and appeals.
